Nepal's new journey towards new forms of workforce flexibility, insecurity and intensification

Capital has been always trying to give the fair share of the labour and segregating labour by using various forms in the workplace. From the history we have been witnessing these conflicts of labour and capital. Even the capital knows that Capital has no meaning if the labour is removed from capital thus the capital only wants to exploit it without removing labour from capital. Out of many such types of exploitation wage thief, poverty wage and wage slavery were the common forms in the world but now the workplace flexibility has been seen in practice through the legal framework. Contractual labour without labour rights and new laws which prohibits the trade union rights and right to strike are the dangerous symptom to kill the trade union in the workplace. The capital is now trying the redefining the blocking trade unions in the workplace through the provision of "no work no pay".

Recently Nepal has passed a bill on industrial and business enterprises which clearly prohibits the rights to strikes and subject to "no work no pay" through by passing the existing labour acts. Not only this other sectoral laws are also in line to be passed to suppress labour rights in respective enterprises i.e. in bank and financial institutions, medical and health enterprise etc.

Now, in such situation trade unions has to be pro-active to defend their fundamental rights. This paper will explain how Nepalese Trade Unions jointly struggling to safeguard the trade union rights through the Joint Trade Union Coordination Committee, & individual national centres. How they are reaching to the Political parties which are leading government and how the state itself acting as capitalist during the transitional phase when state and its powers are being restructuring. It is not a surprise that how political parties are treating trade union's mass members as only vote bank to get power and neglecting when they are in power. What are the challenges they have been facing and how the social dialogue is being minimized to suppress the trade union rights and exploit the labour. This paper will also highlight the key points of on current situation on how the state is favoring to the capital and how the state will repay the cost of such activities in future.
